김 변호사는 "검사가 이미 증거를 확보하고 제출한 상황에서 우리 쪽에서 증거를 준비해 대응해야 하므로 무죄 변론은 쉽지 않다"면서도 "확정판결 전까지 범죄자가 아니라는 무죄추정의 원칙하에 의뢰인이 무죄라는 것을 밝히기 위해 노력한다"고 말했다.

◆김한설 변호사 "강간 상해 사건 무죄 소송 기억에 남아"

김한설 변호사는 과거 진행한 여러 소송 중 가장 기억에 남았던 사건으로 국회의원 공직선거법 사건과 강간 상해 사건을 꼽았다.

 

두 개의 사건에서 법무법인 상승에서 진행한 국회의원 공직선거법 사건을 무죄로 이끌어 냈고, 강간 상해 사건으로 진행된 소송은 강간 부분은 무죄로, 상해를 집행유예로 이끌었다.

 

김 변호사는 민사 소송 사건으로는 변호사 2년 차에 진행한 사건 하나를 꼽았다.

 

김 변호사는 "당시 차용증을 써준 의뢰인에 돈을 갚으라고 들어 온 소송이었는데, 1심에서 패소한 사건을 항소심에서 뒤집은 적이 있다"며, "이미 1심에서 판결이 나온 사건이라 뒤집기 쉽지 않았지만, 전략을 잘 세우고 증인 신문을 통해 판결을 뒤집고 승소하게 됐다"고 설명했다.

 

이어 김 변호사는 "당시 사건을 맡기러 온 의뢰인도 승소할 수 있을 것으로 생각하지 않았다"며, "불가능해 보이는 사건을 뒤집고 나니 다음부터 사건을 맡게 될 때 자신감이 생겼다"고 말했다.

 

He cited the National Assembly Election Act case and the rape injury case as the most memorable of the many cases he took in the past.

 

He proved his clients’ innocent in both cases. In the case of rape injury, the rape was proven not guilty and the injury probation.

 

He also cited one civil lawsuit he took on in his second year.

 

“At that time, it was a lawsuit in which the client who wrote the IOU was asked to pay back the money, and the case that he lost in the first instance was overturned on appeal. It was not easy to overturn the case because the verdict had already been made in the first instance, but after a good strategy, the decision was overturned through the witness newspaper and the case was won. Actually, my client didn’t think we could win but after overturning a seemingly impossible case, I felt confident the next time I took on a case.”
